Terms of Service.

These Terms of Service ("Agreement") govern your access to and use of the autonomous software testing platform, CLI, and AI agent swarm provided by Testiva AI, Inc. (testiva.xyz).

Principle 01

100% IP & Patch Ownership

You retain full ownership of your source code, test artifacts, and all Auto-PR patches generated by Testiva AI.

Principle 02

Authorized Targets Only

You may only dispatch the Testiva AI Swarm against domains, staging URLs, and APIs you own or are authorized to test.

Principle 03

Human-in-the-Loop Merges

Testiva opens isolated side-branch Pull Requests; your engineering team retains final review and merge authority.

Section 01

Acceptance of Terms & Workspace Eligibility

// TL;DR: By creating an account on testiva.xyz or running @testiva/cli, you agree to these terms on behalf of your organization.

By accessing testiva.xyz, installing the Testiva AI GitHub/GitLab Application, or executing the @testiva/cli binary, you agree to be bound by these Terms of Service and our Privacy Policy. If you are entering into this Agreement on behalf of a company or legal entity, you represent that you have the authority to bind such entity.

You are responsible for maintaining the confidentiality of your workspace API keys (TESTIVA_API_KEY), enclave tokens, and OAuth credentials.

Section 02

Permitted Use & Authorized Target Environments

// TL;DR: Only point our Hunter & Security fuzzing agents at apps and domains you own. Never use Testiva to attack third-party websites.

Testiva AI deploys autonomous headless browsers, stochastic fuzzing agents, and OWASP vulnerability probes. Because these agents actively test boundary conditions and security controls, you warrant and covenant that:

  • Domain & Infrastructure Ownership: You will only direct Testiva AI agents toward URLs, staging environments, preview deployments, or IP addresses that you own or have explicit written authorization to test.
  • Prohibited Conduct: You will not use the platform to conduct unauthorized penetration testing, denial-of-service (DoS) attacks, credential stuffing against third-party systems, or scraping of non-consensual third-party data.
  • Production Safeguards: When running destructive Hunter or Security fuzzing agents, you agree to use non-production staging environments, sandboxed payment gateways, or read-only personas.
Section 03

Intellectual Property & Auto-PR Code Patches

// TL;DR: Your code stays yours. Any bug fix or pull request generated by Testiva's Auto-Fixer belongs 100% to you with zero royalties.

Customer Property: As between the parties, you retain all right, title, and interest in and to your application source code, DOM structures, test scenarios, session recordings, and confidential data ("Customer Data"). Testiva AI claims zero ownership over your proprietary software.

Assignment of AI-Generated Patches: To the fullest extent permitted by law, Testiva AI hereby assigns to you all right, title, and interest in and to any code diffs, patches, pull requests, and test assertions synthesized by the Testiva Remediation Engine specifically for your repository.

Section 04

Subscriptions, Run Quotas & Free Trials

// TL;DR: Unlimited developer seats on all plans. Re-verification runs for flake prevention are always free. Cancel monthly plans anytime.

Testiva AI offers a free Developer tier (250 runs/month), a Pro Swarm tier (starting with a 14-day free trial), and custom Enterprise Enclave agreements:

Automated second-pass MicroVM runs triggered to verify a bug and eliminate false positives never deduct from your monthly run quota.

OVERAGE & RENEWALS

Subscriptions renew automatically each billing cycle unless canceled prior to renewal in your workspace settings.

Section 05

Service Level Agreement (SLA) & AI Review

// TL;DR: We guarantee 99.99% uptime for Enterprise plans. Always review Auto-PR diffs before merging into production.

Testiva AI maintains a 99.9% monthly uptime commitment on Pro Swarm plans and a financially backed 99.99% SLA on Enterprise Enclave plans.

Human Review of Auto-PRs: While Testiva AI validates all generated patches inside an isolated sandbox prior to opening a Pull Request, AI-generated code patches are provided as developer assistance. Your engineering team remains responsible for reviewing and approving Pull Requests before merging into production branches.

Section 06

Limitation of Liability & Governing Law

Except for breaches of confidentiality, intellectual property indemnification, or gross negligence, neither party shall be liable for any indirect, incidental, special, or consequential damages. Each party's aggregate liability under this Agreement shall not exceed the total fees paid by Customer to Testiva AI in the twelve (12) months preceding the claim.

This Agreement is governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
